INFORMATION COLLECTED ON THIS SITE

When you visit www.lonepointcellars.com, our statistics and analytics package from Google collects some basic information about your browser. Examples include what type of browser and operating system you are using, how long you remained on our site and what pages you looked at while here. This helps us understand how visitors browse our site, so that we can make their shopping experience better. We also collect personal information about you at various points, including your name and email address (and other information) from the mailing list sign-up form, booking information, and additional personal and financial information from the order forms that you complete during a purchase.




PROTECTING YOUR INFORMATION

We are the sole owner of the information collected on this site. Any data that we store about you is kept behind a secure firewall in our database and is not accessible to the public in any way. Any sensitive information (such as credit card number and/or social security number)that we collect from you is encrypted with SSL, a standard internet security measure. We do everything in our power to protect user data offline as well by restricting access to information to only those employees who need the information to perform a specific job (for example, a Customer Care representative). All employees are kept up to date on our security and privacy practices and are aware of the importance of keeping customer data secure and safe at all times. The information you provide to us on this website is only used to send you our offers, complete your rental booking, and to process and ship your order. We may also use this information to send you information regarding new features, services and special offers from us and/or our business partners that we think you’ll find valuable. This information is harvested from a secure area and encrypted for our customers’ protection. We will not sell, share, or rent this information to others, except as otherwise disclosed in this statement. Although we use outside shipping companies to ship orders and a credit card processing company to bill users for goods and services, these companies do not retain, share, store or use personally identifiable information for any secondary purposes. We value your privacy, and will never release any account or personal information to any third party unless we are given explicit authority to do so by you, our customer.




GIFT RECIPIENTS

If you send a merchandise, stay, or wine gift from our site, we will collect contact information, such as name, shipping address and phone number for gift recipients to ensure correct gift delivery. We will not sell, share or rent any contact or personal information for invited friends or gift recipients with third parties, but they may receive offers from us and/or our business partners highlighting new features, products, services and special offers we think they will find

interesting. Invited friends and gift recipients can easily opt-out of receiving any marketing messages or newsletters by clicking the unsubscribe link available in the footer of each email.

This website may contain links to other websites. LPC is not responsible for the privacy practices of other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each site that collects personally identifiable information. This privacy statement applies solely to information collected by this website. Lone Point Cellars reserves the right to modify this privacy statement at any time, with or without notice to its customers.

ORDERS AND SHIPPING

We have partnered with Vinoshipper and UPS for all online wine & merchandise orders. When your order ships you will be sent a UPS tracking number. You can also login in to your UPS account and look in Purchases where you can click on the tracking number for the status.

During Checkout you will be asked to enter your shipping address or that of your gift recipient. Remember that there must be a person who is 21 or older there to receive it. Please note, there are some States that do not allow direct shipments. We will let you know if your shipment is possible prior to completing the order.




ORDER ACCEPTANCE POLICY

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. In order to protect the interests of LPC and Vinoshipper, all orders placed over $2,000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud department. We may require additional verifications or information before accepting any order.




RETURN / REFUND POLICY

We are committed to you having a positive experience when shopping with us. We want to hear from you if there is a problem. However, due to the special nature of the Products sold through our Website, there are some special rules affecting returns/refunds. In the event that you have not received the Products that you ordered: Please email customerservice@vinoshipper.com with your order number so they may investigate the reasons.




DAMAGED PRODUCTS / INCORRECT ORDER

If the damage is visible, do not accept the order from the shipping company. Please email customerservice@vinoshipper.com with your order number and which products are damaged. They will work with you and LPC to get the Products replaced.

We use UPS for our carrier but you are responsible for selecting the shipping method. Lone Point Cellars nor Vinoshipper assume any liability for Products that are or may be damaged by heat or cold during shipping. If you feel that temperature extremes could impact the quality of the Products we suggest that you choose an express shipping method to help protect your purchase or delay your purchase. If our website indicates that the Products are or may be in short supply, please call 866-678-8466 and they will try to help you to ensure that your order can be accepted but the Products shipped at a later date.




THE SALE OF ALCOHOLIC BEVERAGES

LEGAL REQUIREMENTS

We do not sell alcohol to persons under the age of 21 and ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site, you affirm and acknowledge that you are over the age of 21, that the person placing the order and receiving a shipment of alcoholic beverages from us is over the age of 21 and that receipt of shipments containing alcoholic beverages requires the signature of a person 21 years of age or older who is not intoxicated. You also agree that any alcohol purchased from us is intended for personal consumption and not for resale. If you do not agree with these conditions of use, please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, we will prosecute you fully to the extent allowable by law. As required by the Communications Decency Act of 1996, we hereby notify you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to content that may be harmful to minors.




RENTAL & LODGING TERMS (COTTAGES)

By booking our properties, You, our Guest agree to all Lone Point Cellars rules, requirements, terms, conditions, and restrictions listed here.

Our properties are run as short term vacation rentals (self check-in and checkout).

Check-in time: AFTER 3:00 pm.

Checkout time: BEFORE 11:00 am. 

A Standard Processing Fee of 4% will be applied to all direct bookings.

Guests who check out later than 30 minutes will be charged $100. Guests who check out later than 1 hour will be charged an additional $250, and will be subject to removal before 3:00 pm.

Cancellations made within 5 days prior to arrival are non-refundable.

Airbnb Guest cancellations made within 5 days prior to arrival are non-refundable.

Airbnb Guests that book using our 10% Off option forfeit their refund no matter when they cancel.

For cancellations that are approved within 5 days for a refund, guest will be subject to a standard $75 Last Minute Cancellation Fee. 

We’re Pet friendly: $50 Pet Fee per pet (Airbnb Guests may pay through our Venmo account “lonepoint-cellars”, or in person at our Tasting Room).


PETS (DOGS)

Pets under 50 lbs - maximum 2 pets per room [call Guest Services for exceptions]

Pets must be appropriately restrained by guests & must be kept off of furniture and beds without the use of the dog blankets provided.

Pets must be kept on a leash when on the property unless they are in the guest's room.

Pets must not be left unattended. Crated pets are the exception.

Pets are not allowed inside any food and beverage areas. This exclusion does not apply to guide dogs.

Guests are responsible for cleaning up after their pet on any part of the property.

Any disturbances such as barking must be curtailed to ensure other guests are not inconvenienced.

Guests are responsible for all property damages and/or personal injuries resulting from their pet(s).

Guests agree to indemnify and hold harmless Lone Point Cellars, from all liability and damage suffered as a result of the guest's pet.

Lone Point Cellars reserves the right to charge the guest's account commensurate to the cost of such damages.


ADDITIONAL LODGING TERMS

Large gatherings, Events, or parties are not allowed at The Cottages, and only allowed at The River House with permission. 

Unregistered guests are not permitted to stay overnight on our properties.

Cigarettes are allowed in our designated areas only, and never inside our properties. $250 Cleaning Fee will be applied for Cigarette, Cigar, Marijuana smoke damage inside our properties.

Recreational drugs are prohibited at all times in all locations on the property.

A $50 Electronics Reset Fee will be charged for all devices and electronic systems that have been reprogrammed, reset or otherwise improperly adjusted during your visit.

You will be responsible and charged for any damage to our properties and their furnishings your group or pet cause during your stay. A minimum $250 Fee will be applied to your booking.

All property both in and outside our Cottages and River House belongs to Lone Point Cellars. Any missing or broken items will be charged back to you for repair / replacement. A minimum $250 Fee will be applied to your booking.

Minimum fees are just that, significant property damage may require larger charge backs to you.  Lone Point Cellars reserves the right to pursue damages for significant property damage caused by guest visits, accidental or otherwise, and will charge the guest's account commensurate with the cost of such damages.

A Bio Cleanup Fee of $100 will be applied for soiled Linens (urine/feces/blood/vomit), and a $250 Fee will be applied for any bio damage to bedroom mattresses and sofa beds.

A Bio Cleanup Fee of $100 will be applied for any surface were (urine/feces/blood/vomit) is needing cleaned up.

A Bed Overuse Fee (River House) of $50 per bed, per night will be applied to all beds used above your reserved head count or agreed to prior to check-in. 

A Guest Cleaning Fee for 11+ Guests (River House) of $50 per stay will be applied to groups of 11 or more.

All bookings are subject to State and Local taxes.


RENTAL & LODGING TERMS (THE PARK)


CHECK-IN
Check-in time is 1:00 PM.
CHECKOUT
11:00 AM

for all sites. Late check-outs can be requested (subject to availability) but require pre-
approval from guest services. Unapproved late checkouts over 30 minutes will be assessed an additional daily
rate.
AFTER HOURS ARRIVAL
For arrivals after 10:00 PM, please call 509-220-1326 to inform us of your expected arrival time.
QUIET TIME
The Park's quiet time is from 10:00 PM – 8:00 AM daily (no loud gatherings, loud music, loud
electronics, etc.). The use of generators is prohibited. Note: You are staying on an active farm.
The month of May you may hear our wind machines that activate on frosty nights to protect
our crops. June you may hear early morning harvest sounds as cherries are being harvested
nearby.
PETS (DOGS)
Park Management reserves the right to reject the admittance of any pet. Pets are not to be left
unattended outside at any time. Any pet fencing must be on the concrete site and cannot cross onto
the adjacent landscaping. Dogs must always be on a leash. Although we welcome on our outside
patio, pets are not permitted inside the Tasting Room. Please be sure to pick up after your pet to
avoid additional fees. You will be responsible for any damage or injuries caused by your pet. Do not
feed or encourage any stray pets!
ALCOHOL / SMOKING
Alcohol is permitted to be consumed in the Park in a responsible manner. Open containers of alcohol
cannot be transported from the tasting room to the Park. Smoking is prohibited in all common areas
in the Resort.
TRASH
To maintain a clean and beautiful environment, a trash receptacle is located near the southwest end
of the Park for your convenience. Please do not leave trash out overnight
Firearms – No discharge of firearms allowed, and no fireworks allowed
Fish Cleaning – No fish remains allowed in trash bins or dumpsters
Fires – allowed in fire pits only if there are no county burn restrictions
OCCUPANCY
The maximum number of registered guests allowed per site is 6. A $10 fee will be applied for
additional overnight guests. Stays longer than 28 days must be approved by Park management.

WASTE HOOK-UPS
Sewer hoses must be undamaged and sewer connections must be tight.
VEHICLES
Two vehicles per site. Parking is NOT allowed on the driving lanes, grass, or any vacant sites.
Parking rules will be always enforced and may result in towing at the expense of the guest or vehicle
owner.
SPEED LIMIT
The posted speed limit is 10 mph. Failure to follow the speed limit may result in eviction from the Park
with no refund.
GUEST / VISITORS
Guests are responsible for their visitors and liable for any damage that they cause while on the
property. Visitor vehicles will need to be parked on the pad of the guest they are visiting or in a
designated parking area on the property.
WHEELED / MOTORIZED TOYS
Remote-controlled toys and drones may be operated if they are not distracting or bothering other
guests – please shut down upon request.
Pickleball, Pavilion and Golf areas first come first serve
PARK RESTRICTIONS
No overnight tent camping or A-Frames. Well maintained Truck campers and Pop-Ups are allowed.
RVs 20-years or older must be approved by guest services prior to making the reservation. Jack
pads are required for all RVs.
CANCELLATION POLICY
Cancellations made more than 7 days in advance will be refunded in full, less a 4% processing fee.
Cancellations made inside 7 days before check-in are non-refundable. Guests who fail to arrive for a
reservation by 1 p.m. the day following their reservation must notify us for the site to be saved. After
1 p.m. the site will be rented out.
REFUND POLICY
There are no refunds after check-in. Refunds will not be given due to weather conditions, voluntary
departure, acts of nature, or evictions. Any refund for pre-check-in cancellations will be processed by
the same method that the reservation was originally paid for or a reservation credit may be issued
towards a future stay to be used within one year from the original reservation dates.


DISCLAIMER

The Park at Lone Point Cellars owners, management, and staff (hereinafter referred to as the Park

reserve the right to both refuse service and collect for any damages caused by all person(s) while on the property.

By continuing this booking, you our guest, agree to the above provisions,

and consent to read and abide by the full terms and conditions available on our website.

The Park assumes no responsibility for accidents or injuries to guests or visitors The Park reserves the right to evict any person(s) for conduct the Park deems to be detrimental, including negligence or willful misconduct, and aggressive pet behavior without a refund.

The Park will not be responsible for damage to Recreational Vehicles or other motor vehicles, accidents or injury to guests, or loss of money, laundry, valuables of any kind. Violation of any of the provisions contained herein is grounds for removal

from the Park at the sole discretion of The Park at Lone Point Cellars Management.

CREDIT CARD CHARGES

Orders and rental bookings are by credit card only. We accept Visa, MasterCard, Discover and American Express. The billing address for any such credit card needs to be provided at the time of your order and must be the address on your credit card statement.


ERRORS AND OMISSIONS

Occasionally, our listed prices, rental prices, bottle sizes or quantities may be incorrect. We make every effort to make sure that our product database is accurate, however, in the event any such mistakes occur, we shall be held harmless for any such errors.



WINE CLUB

Wine Club members will receive 3 wine club releases per year. An email will be sent prior to billing & release for customizing. Tasting Room pick ups must be obtained within 30 days or allocation will be shipped at members expense. Wine Club members who choose to ship will have their card on file billed for each release. Adult 21+ signatures are required for delivery and all members must be at least 21 years old. We ask for a one year commitment, however a member may cancel after taking 3 allocations. Cancellations within one year must be emailed 30 DAYS prior to any release & a fee of $50 will be applied.
